175 or 176?!

Hi all,

We had confirmation this week from the skills assessment putting my partner on the MODL, the CSL and (due to very recent changes) on the list for possible QLD state sponsorship. We now have choices that we never dreamed possible!!

We definately want to be in Brisbane as we have lots of friends there, and like the flexiblity offered by a 175 Skilled Independant visa in terms of being able to live where we like, but my understanding is that a 175 visa would be quite low down the priority processing list.

I've read a bit on the 176 Skilled Sponsored which the immi website describes as "for people who don't have the points for 175". If the sponsorship is regional, are there restrictions on this one?

I think we have ruled out the 475 Skilled Regional Sponsored as we would need to live in a Specified Regional Area for 12 months.

Am I right in thinking that both 176 and 475 would get priority processing above the 175 Skilled Independant??

We have used an agent to get us through the skills assessment, but I'm quite underwhelmed with her so far. She insists there is no difference in proccessing time but all i've read here and in the immi faqs says different.

Sorry for such a long first post and thanks in advance. I've got loads more questions but will do some more hunting through old posts first!

There's a slight difference nicky with 176 State Nomination regardless of whether there is CSL occupation or just MODL involved and the 176 is not regional.

Have a look at the priorities as they are for the moment @ http://www.immi.gov.au/skilled/gener...processing.pdf

The agent could have done that so simply and should have and sometimes if they are not divulging simple information, one would be forgiven for thinking they just wanted to keep clients in the dark and have them pay fees.

Once you decide what you want to do, the information on the Immi site is quite well layed out and clear enough for most people to do their applications themselves.

Hi Wanderer, thanks for such a quick reply. I'm still trying to get my head round it all, so please bear with me!

Does that mean that the 176 is state sponsored but we can go anywhere rather than to specific regions within the state? I think i'm getting some of the language twisted up here!

In fairness to the agent she did send us the faq. I think she's saying that by the time we've got confirmation of state nomination and then applied for a 176 visa, it will all take about the same time as the 175.

A 176 nomination[sponsorship] is state wide for any particular state whereas it is the 475 visas that are for regional areas of particular states.

The visas themselves getting processed by DIAC and the states having nothing to do with that other than someone may have decided to seek sponsorship, it taking in order of something like 2-4 months.
You'll see on What's New? Recent Changes in General Skilled Migration a link to Nomination by States/Territories and have a look from there, some states sites easier to negotiate than others.

It's hard to assess if there is going to be a time benefit though if you put in your 175 application and at same time are having a state nomination processed, as soon as that comes through, your 175 application immediately becomes a 176 application without going to the back of the queue.

On the other hand if you just have a 175 application in and someone else puts in a 176 or has a 175 converted to a 176, their application will move ahead of you and have too much of that happening and you could be going backwards.

I've seen elsewhere that all CSL visas are starting to move through the system as far as processing being reasonably prompt and some non CSL applications will start to be processed so a CSL non SN should move forward reasonably well if you get it in quickly enough.
