Unhappy PLEASE HELP- Very Confused 417 Visa Holder


Just wondering if someone can please help me.

I am on a 417 Visa which is due to expire on the 12th of Feb and I have flights booked to go home for this date (I have to travel then or before then of they will expire) - Approx 4.5 weeks away. My boyfriend has just been offered sponsorship from his current company in Sydney, we have been together for 20 months now and I am applying for De facto on his visa.

I am so confused about everything - to be honest I dont really know where to start.

I really want to take my flight home so basically I think I have two options- to either apply for bridging visa B (I have a viable excuse, well I think I have anyways, I have a sick gran aunt who is unfortunately on her death bed, this will be the last time I will see her?) or, to travel on around the 1st of Feb and get back to Sydney before my 417 Visa is up- it will literally be a day before it expires so does anyone know if I would have any problems getting back in to the country?

Also does anyone know if I am able to work on a bridging visa?

Any information would be really helpful as I am so lost as to what to do.

Hi Barbara, welcome to the forum and sorry to hear of your gran aunt's illness, always a tough time when someone you've been attached to a bit is a long way away and time counts.

I'm not 100% sure but I'd reckon that if you're on your Bf's sponsored visa application [a 457 is it] as a secondary applicant it'll not matter if you're out of the country when the visa is granted.

I've got a couple of things on my list to check with Immi and will add that but if you get the chance yourself, it's just a local call cost from anywhre in Australia to ring 131881, press the right buttons and get an operator, keep the question straightforward - just ask re the 457 being granted if you're out of the country for starters and they'll usually give you a very direct answer.

If it's No, then you could ask about a bridging visa but a Bridging Visa B is usually granted only when you already have a Bridging Visa A to my best knowledge.

As long as you have an eligible visa to return on, that's normally OK but I suspect it's certainly raise questioning if you returned on a visa that was expiring the same or next day and had no follow on Bridger in place.
Hopefully something can be in place for you to have had a Bridging visa granted between the 417 expiry and the 457 granting.

Plan B

First thing that needs to be addressed is getting the 457 application in with you as a secondary.
Second step I suspect is best approaching Immi re the predicament of you by chance wanting to return between the 417 expiring and the 457 being granted.
There's a good chance if Bf's company is eligible and he too, then a 457 could be granted fairly quickly, perhaps even by 12 February if all move smartly.

So initial question can remain as above re you being out of the country when the 457 is granted.
Subsequent Questions can be re 457 not granted by 12/2 and having a bridging visa in place and you could ask is that possible if as soon as the 457 application is in, you ask for a cancellation of your WHV.
And then because of uncertainty of granting date, can you then get a B to leave and come back on because of GranAunts poor health.

Haven't answered your dilemma but hopefully gives some order to what you need to consider and I'll re-post re what I find out on asking those questions too.
