After - 3 Years Exclusion

Hey guys,

I was banned a 3 years exclusion as at July 2010, departing Australia.

What happened: ??

I failed my units in my final semester in uni. The time when I repeat, my student Visa was left nearly expired, until the Exact "28th" day of grace period I got aware and rushed to immigration but it was too late, door closed.

So my Visa was 1 day expired (Law is Law, I respect that.)

As a result a 3 years exclusion period implied on my passport.

What Now?

3 years later, today, 2013 Nov I am planning to visit Melbourne again to propose to my girlfriend. I was told that the exclusion / ban was valid for 3 years and mathematics was right, as a result I booked my air tickets and lodge my Visitor Visa online and I got rejected.

Can any experienced fellas advise my situation or leave any useful comments so that I can make her my happy bride in this beautiful place?

Was there a reason given for the rejection?

Original Nationality: US
Visa #1: PMV (300) through Washington, D.C
Applied: April 2013.
Visa Granted: January 2014.
Visa #2: Subclass 820 (From PMV).
Applied: End of April 2014.
Visa Granted: Early July 2014.
Visa #3: 801 (PR)
Eligibility Date: End of April 2016 (Applied a month prior).
PR Granted: Early April 2017.

Most likely there would be "genuine visitor" concerns. The previous ban and the fact that you have a partner in Australia may be considered additional risk factors. Your best option may be to apply for a Prospective Marriage Visa first, then apply for another visitor visa. Alternatively, you could apply for another visitor visa and provide overwhelming evidence that you will not remain in Australia and have plenty of reasons to return to your home country.

Thanks guys, it was an automatically generated reply that of rejected my visa online. I am on my way to local embassy to check out where's the problems.

Does anyone suggest lawyers or professional advise?

I always suggest that people seek professional advice, especially after refusals, but being a migration agent, I'm obviously biased when it comes to that.

If you use a lawyer, make sure that they actually specialise in migration law. Migration agents usually only deal with migration matters and are often less expensive than lawyers. Just make sure that you only deal with registered agents !
