Ok yh , was original plan, apply offshore, we rented house for a year in Banyuwangi, East Java, i just been there for 3 weeks to set it up etc, thanks for your help, just apply offshore then.

Hi,

You can apply for the offshore 309 visa and then after you have submitted your application you can apply for a tourist visa. It has been said on this forum that they often grant tourist visas to people who have a current offshore partner visa application pending because they know they are not likely to overstay their visa as they have to go offshore to have their partner visa granted.

You can apply for the 309 and then when you wish to come to Aus, apply for the tourist visa. Make sure to let your CO know of your travel into Australia so that they can notify you of your partner visa is about to be approved so your wife can travel offshore (doesn't have to be Indo, it can be anywhere except Australia. NZ is a common destination used).

You need to do it outside Australia, yes. Have you read the partner migration booklet? Good place to start. It gives you lists of all the evidence you need to gather and everything you need to do.

Also read all the info provided on the immi website for 309

You could get the application in and just wait till after the baby is born to do the medicals. You could also start the criminal history check process now as it can take a while

Yeh we did ours ourself. So long as you do your research I think it's fine unless it's very complex. Just make sure you cover all 4 criteria

40sp if you are the sponsor. From the top of the first page of the document, in bold text:

This form 40SP is to be completed by the sponsor of
persons applying for a partner category visa either
outside Australia or in Australia.
If the fiancÚ(e) or partner you are sponsoring is
applying outside Australia, your fiancÚ(e) or partner
will be applying to migrate. If your fiancÚ(e) or partner
is applying in Australia, your fiancÚ(e) or partner will
be applying for permanent residence. In this form, the
term ‘migrate’ covers both.


Google is your friend. If you're doing the application yourself and still not sure who should be filling out each form, then I suspect you are in for a huge learning curve. I have been there and done it myself, and it was indeed a huge learning curve. Good luck.
