VERY URGENT!!holding BridingVisaE,can I apply offshore 175 but stay in Australia??

Me and my partner have finished our degree in Australia and applied 885 General Skilled Migration (de fecto) last month, however, our application is INVALID, because our agent didn't notice that we need a complete skilled assessment, we only submitted the receipt of the skilled assessment. Our student visa is expired on 15th March and we are now holding a Bridging visa E (for a week, but we may be able to extent it if we provide we are in some kind of process that we are going to apply a substantive visa), bridging visa E is not a substantive visa, therefore, we cannot re-submit our PR application (885) and I don't think we can apply 485.

I am thinking about applying offshore GSM visa, I know that application for an offshore GSM visa are usually made from outside of australia, however, i also noticed that I may make an offshore visa application while in Australia provided the conditions attached to my current visa do not prevent me from doing so. and we will need to go oversea to collect our PR if it is granted.
I wonder if we can apply offshore GSM and we stay in australia.

I know that bridging visa E isnt a substantive visa, therefore we need a valid visa to stay here and apply for PR.
we desperately need some help to solve our problem, we have a dog and a car here and we cannot leave this continent.

I'm not at all familiar with the BVE and from Bridging Visa E – Primary Processing, Judicial and Merits Review it seems that one is only used where a former BV has ceased.

Offshore GSM visas can be applied for in Australia but bridging visas do not apply at all in respect to offshore visa applications even if applied for here.

You certainly need to have a good look at any visa information yourself rather than rely on an agent.
Have you now got an assessment of your qualifications and if so, have you checked that you cannot apply again for an 885 visa, or perhaps even a 485 may suit as an interim one.

Are you sure that they are registered agent? This appears to be a huge mistake of a very basic nature. If you did not have a positive skills assessment at time of lodgement a subclass 485 application should have been lodged.

This is a very serious matter and with all due respect, I do not believe an internet forum is the best place to obtain advice on a decision that will affect the rest of your life.

Off the top of my head I do not believe that a BVE will qualify you to apply for a subclass 485, but would need to carefully research the regulations to be sure. You may be able to lodge a student visa, but again the regulations would have to be consulted.

A serious mistake has already been made and it is important that your next step is researched carefully as the regulations are constantly changing.[/QUOTE]

A subclass 175 can be lodged while you are on or off shore (if you qualify), but there is no bridging visa.
