Spouse visa details

Dear Wanderer,
How are you? I am Ritu
I am Indian.I got visa 176,and i am planning to settle my life in Melbourne on June.2010
I am unmarried,now i am going to marry a Indian girl on May 2010.
What is the processing for Spouse visa? Is 309 visa category.....
I want to bring her immediately, once i reached there it may be July or August...Shall i arrange for tourist visa to her.
How long will tourist visa valid?
How can i apply spouse visa while she is staying with me in Australia. or will she return to India.
She is Software engineer

Congratulations on your imminent marriage Ritu and yes in applying for a partner visa overseas once married it'll be a 309 visa.
As well as applying for that visa you could see if a tourist visa would be granted while it was being processed and then when it was ready for granting or the tourist visa was to cease if earlier your wife would have to leave Australia.

If looking to get a tourist visa you may want to apply for a six months one as that may give sufficient time for processing of the partner visa and when the visa was ready for granting your wife would only need to travel to New Zealand, not all the way back to India.

The problem with having your wife travel to Australia on a tourist visa with intent of submitting a partner visa here is:
1. Immigration may say, well you're not really coming here as a tourist and refuse your partner entry.
2. Tourist Visas can likely have a No Further Stay condition and thus she would not be able to apply for a partner visa, even if married.

Have a good read of the partner visa eligibility and applying for this visa sections, use the Checklist and also read Booklet #1 for details of type of information you should include.
