Spouse Visa (Sub 309) from India

Hello

I am from India.I got my PR last year but yet to make initial entry. Last Month i got married.
1. Can I apply for spouse visa for her keeping in view that i have still not made initial entry there?
2. Can i apply visitor visa for her for the time being? What are the chances of visa grant as i am visiting australia on PR visa & she on visitor visa?

Please reply asap.

While you may have been granted a PR visa, you do not in effect have PR until you activate the visa.
There are in fact different sections of Immi, one being their processing group and then the actual border control and visa activation is another.

I am not aware of their interaction detail but suspect that details like what visa has been granted and whether a visa has been activated or not would be key information accessible by either group from their computerised system.

As to whether the processing group would accept a visa application for which you will be the sponsor whilst you have not activated your visa, I'd also suspect the answer to be No.

But best you check it with Immi, either via contacts linked @ Contact Us - Department of Immigration and Citizenship or if you had contact with a CO, they would be a reliable source.

I'd also suspect a tourist visa would be more likely have a chance of being issued once there was a partner visa application submitted by your wife first.

1. ok if i make my initial entry there and stay there for a month & come back to India, Can i apply for spouse visa successfully from india still keeping in view that i have not settled in Australia & doing job in India.
2. Another question, If do not apply for spouse visa , May i apply for tourist visa for her to get accompany on my initial entry?

Once your PR visa is activated, I'd see no reason why on return to India your wife should not submit her partner visa.
There is substantial information you need to get so have a good read of eligibility and applying for this visa sections of the visa, Booklet #1 and make good use of the applying section Checklist.
You do not need to stay in Australia for a month to validate and just flying in to have your passport scanned and then leaving later that day is sufficient.
That way, you can keep your costs down and your wife would not even need to travel.
I have seen at least one post here that getting a tourist visa in India is not always a too straightforward matter and at best it could take some time.
