Hey Guys,

I'm inquring on behalf of a friend of mine. She met her partner about 6 months ago. He is from the USA. He is on a student visa studying at the University of Queensland. His student visa expires on August 31, 2016.

They met last year in October, fell in love and she wants him to stay in Australia and is looking to sponsor him on a partner (820) visa.Their replationship isn't going to be 12 months old at the time they will be applying for a partner visa in August 2016, he is living with my friend at her apartment.

They both are moving in with her parents soon to be able to save up for the visa fees. He has met her whole family and she plans on going to the States later on when the partner visa application has been submitted.
They are also applying to register their relationship in the coming weeks to waive the 12 months requirement since they both reside in Queensland.

Because they won't be together for 12 months at the time they apply for his partner visa, are there chances that DIBP will still consider their relationship geniune and continuing. I have suggested her to see a MARA agent for a consultation before applying for the visa.

Are there people out there who have gotten their partner visa approved but haven't been together for 12 months at the time of application? Do they have a chance? They will have a whole heap of evidence to support their application by the time they apply.

Hi Becky. Their situation is a bit similar to ours. We submitted de facto visa after 10 months dating and 2 months living together. But we had compelling reason as my partner was pregnant. registering relationship obviously waves 12 months living together requirement. However, considering how tough DIBP can be you still have to proof the relationship before and after you applied. I would suggest ask this question to Mark. As for us we still waiting the 820 visa.

I applied a year ago, and from UK but still nothing. I think there's still quite a wait infront of you

I also applied online through a immigration agent Onshore and completed the medical today.

My agent dun tell me anything up till now, assume is goood news. I had a job in here and live with my hubby is more than else.

Yeah I know. But with the January-April people hearing something from immigration, you never know

Although like I said, my friend from the UK applied and waiting 18 months!! Though I think his might be an outlier

Oh!! Did your immigration agent ask you to complete the medical already? Huh I wonder if I should contact my lawyer to see if they've heard anything.

So interesting, when I finished my medical check up and came out from the center, I received my agent text message to ask me to book the medical check up.

My hometown is Hong Kong.

I'm doing my medical on Wednesday, a year after applying - figured it's not gonna take 2 years so it won't expire, then it's a straight up application and they shouldn't have to contact me for anything

Thanks for your reply Congratulations on the good news. Hope you and the little one are doing well.
I have told her that she will need to supply a lot of evidence and also that they consult a MARA agent.

They don't want to hurry into getting married although that too is something they have discussed.
