I applied for partner visa in December 2015 and my student visa got cancelled in may 2016 and immigration gave me BVE whereas I was supposed to get BVA because I had applied for my substantive partner visa before my student visa got cancelled. Anyone knows why this happened! Now this year in march they refused my partner visa in march and I applied for review at AAT.Now the problem is I have to travel urgently overseas because my mother is not well and all this years I feel trapped here but I can't leave my loved one alone here is there anyway I can get BVA? And then apply for BVB

I don't know why would they give BVE to me. I had substantive partner visa application lodged at that time and after all this year I can't even go to see my family moreover BVE is for the one already in departure process I have lodged 820 partner visa that shows clear that I want to stay here not departure but I don't know why it happened but I really need a way out any advice will be helpful to me thanks.

Ours says received for the applicant, and submitted for the sponsor. No change.

They gave you a BVE because you cancelled your student visa. When you lodge your partner visa the BVA is linked to your substantive visa, so when you cancel the substantive visa your BVA gets cancelled too. Therefore, since you have no visa you are essentially here without a visa so they give you a BVE to be able to stay here until a decision on your visa is made.

I came here on student visa I wasn't on BVE when I applied for partner visa I was on my student visa when we lodged our substantive partner visa application in December 2015 and my student visa got cancelled in march 2016 and then they put me on BVE but I already had a valid substantive partner visa application lodged at that time I don't know why would they give me BVE. Even I applied for another study visa in Dec 2015 but they cancelled it too. I feel like trapped and it's not fair it's been more than three I haven't seen anyone from my family. I really want to go home but can't let my loved one here with nothing to come back again. There must be a way out.

The BVA was linked to your student visa, when the student visa got cancelled so did your BVA. Therefore for you to be able to stay in Australia they gave you a BVE. The only way is to apply for another visa (if you can ie, skilled visa) or go offshore and lodge a partner visa. There is no way to change from a BVE to a BVB or BVA.

I applied for another student visa but I didn't got one I never had any idea that this is going to happen. Is there no way I can arrange to visit my family.what if I talk to AAT?

You can go offshore you just won't be able to come back on a BVE. DIBP most likely would not approve a tourist visa either.

DIBP/AAT will not change a BVE.

What can I do now? Can I apply for onshore tourist visa or do something with my job as I'm truck driver can I apply for work permit my boss will agree to write recommendation letter for me as never took off from work. Please there must be something
