801 refusal. help needed urgently please
 
Hi guys I'm new here .
I have partner visa 801 in process and it's being looked at as we speak. We are very hopeful it's going to get granted. But just in case if doesn't what Visa would I go on then ? As I will be overseas at the time of decision?
What are my other options?
Currently on 820 since November 2017.

Cannot remmber the exactly date. But it is around Sep/2017.

Our 820 Granted 10th August 2018
 
Feeling relieved with my Canadian husband. His 820 was finally granted.

Our timeline so far:
June 2016 - received PMV 300
March 2017 - Applied for the 820
May 2017 - Received 'Immi Letter' requesting sponsor get Australian police check and sign consent form. Uploaded a week later.
(....CRICKETS....)
2nd July 2018 - 'Partner Visa is in Progress' email
1st August 2018 - 'IMMI s56 Request for More Information' email requesting applicant get an Australian Police check.
10th August 2018 - Uploaded applicants police check, 820 was granted 2 hours later.

Good Luck to those waiting for their 820. Now to look into our next steps towards 801. Any help/advice appreciated.

Hi guys!
My husband and I applied for our 820 visa last week.
I came to Australia on a PMV which was granted very quickly (5 months for a high risk country). Because I didn't except it to be granted this fast, I enrolled in a few courses and booked patients (I'm a dentist) which I still need to see and continue their treatments.

I applied for a Bridging visa B hours after lodging the 820 application, explained my reasons and it was approved (I didn't need to provide any evidence).

My plan is to return to my home country until the end of the year to finish the course and finalise my patients` cases.

However, today I heard from a friend that going overseas on BVB will postpone the date in which I am allowed to lodge evidence for the 801 visa and also my application will not be seen by a CO until I return to Australia, meaning it would also delay my 820 visa

I couldn't find any information on Immi`s website to confirm that. Everywhere I look it states that the 801 should be lodged 2 years after lodging the 820 application
And although I am aware a 820 can't be granted if I am overseas, I have seen several cases in which the CO has contacted the person informing they are ready to make a decision on their visa and should return to australia

Does anyone have any information on this?

Not sure how people just create misinformation out of thin air. Everyone that applies for a combined partner visa (either 309/100 or 820/801) is eligible for the second stage 2 years after making that application (with the exception of long term relationships that qualify to waive that 2 year waiting period). So there's no way that a BVB could postpone the second stage eligibility.

Also not true that they won't look at your application until you return. They will process your application when they get around to processing it. If you're offshore when they're ready to finalize, they'll notify you that they're ready to finalize but their movement records show that you are not onshore.

Update: My wife received her 820 and 801 within seconds of each other yesterday.

We waited until the last minute before applying for a BVB (hoping it would come through before her trip to see family in Canada), and she was issued the BVB for 7 weeks (usually 3 months wed heard).

After her return we wrote an email advising that she is back in the country, and the grant came through less than 2 hours later!

Very desperate for your help, please help.

I'm overseas at the moment and my 801 has been refused saying my evidences aren't enough.
What do I do now? What visa am I on now?
Can I come back into Australia asap to apply an appeal (aat) ?
How long do I get to appeal ?
What are my options please help.

Hi. I am new here and like many others, My husband (Au citizen) and I submitted my paper application 820/801 (onshore). It was submitted 23/02/17. Just a day ago I received an email requesting a new AFP police check and health examination which I booked the earliest possible. If I don't receive an update from them after I sent them what they need, can I apply the second stage (801) on 23/02/2019? TIA
