As he will be technically applying for both the temporary and the permanent partner visa concurrently, his BVA will carry NIL conditions.

US State Police clearance requested for 820/801

Hi All,

I have applied for 820/801 on Oct 2019 for my wife. (we have been in relationship for more than 15 years by long distance) we got married in 2019 and she moved to Australia with me.
I was requested for new AFP and my Overseas Police clearance, I have submitted it. However, CO got back and again asking for US State Police from NJ clearance which I have processed now and its really slow process from the US. Has anyone faced the same ?

Regards,
Vish

My question is, once we apply for the Temporary and Permanent Partner Visas, will he have full work rights immediately after that?
And if not, if we have to wait until the expiry of his current visa, even after we've applied for the Partner Visas, once his student visa expires and I'm assuming rolls over into a bridging visa, does that bridging visa have full work rights?
Thank you!
James
Hi James,
I applied for my 820/801 from a student visa. Your partner's work rights will have the student visa work limitations until the bridging visa takes effect (after the student visa expires). My understanding is that as the work limitations are only active when the course is in session, once the course is completed the work limitations should not be in effect. However, these limitations still apply while his student visa is still active.
When he is on the bridging visa, he should be able to work with no limitations on hours.
I personally would describe that as full work rights, but when applying for jobs not all companies will see it that way.
Hope that helps!

My 820 visa got granted! Applied myself Feb 1st 2020 and it was granted on Feb 18th! Didn't hear a thing until January 25th when I had police and medical check requests and after uploading my police checks on the weekend it was granted in just days.

Astounded how fast it was to be honest, but being from the UK and settling in regional VIC I think I benefited a lot from last years changes and prioritsations. Honestly can't thank everyone here enough for helping me out over the years.

Am trying to imagine is similar to RFI and therefore hopefully visa will be granted when I complete the health assessments next week

Man, I have received this auto-generated reply requesting information on 3 Feb after 25 months of waiting for SC820, however; I have tried to generate a new HAP ID as my medical has surpassed 18 months but it is not letting me generate by stating that I have cleared the required medical examinations. Do me a favor keep us posted regarding any updates once you complete your health examinations.
