what happened to my PR application when my waiting period is end but I'm in oversea??

Hi there,

I've been reading lots of posts but couldnt find any answer that can resolve my problem. I am now living in Australia with my partner with Visa subclass 801 and my 2 years waiting period will be ended on May next year. But the problem is I am most likely will be in europe for my Master on March, which mean 2 months before my waiting period ended and wont be back to oz till the year after. If anyone can advice me on how this thing can affect my PR application and if it can be still granted when I am offshore. thanks in advance.

You've got some luck running your way for a recent legislative change means the 801 can now be granted while people are offshore.

Just had a read of the detail in that legislative change and one thing you'll need to check [ best to contact Immi on 131881 ] is what the transitional arrangements actually mean re applications made but not finally determined, ie.

The amendments to allow Subclass 801 Partner visa to be granted to an applicant who is outside of Australia will apply to visa applications made but not yet finally determined (within the meaning of subsection 5(9) of the Migration Act 1958) before 27 March 2010, and to visa applications made on or after 27 March 2010.
Just to make sure they mean a 801 is not finally determined until the two years of holding a 820 is reached.

Please post on what you can get clarified for it'll help other posters.
