Never lie to immigration. Aside from the obvious consequences, if you lie about your relationship status it can bite you when you apply for the partner visa.

Tourist visas are for tourists... Ensure you are there to be a genuine tourist and you should be fine.

Yes I was living with my partner in May-august 2012. Maybe you're right we should apply now. Been together for 3 years. He came to America twice in 2011. We have heaps of evidence. But just worried if we applied now we'll get denied bc we haven't met the full 12 months together w/o any gaps. Grrr why does it have to be 12 months....immi makes shyt impossible for ppl grrr.

We're gonna see an agent today for further help. Thx cezzy for ur reply

Gaps are fine! It doesn't need to be 12 months in one block, as long as yu can show that you maintained contact and a relationship while you were not in Aus, ie from August tillDecember last year. Do you have proof of living together between May and August ie a tenancy agreement or stat decs from the landlord that you were together? I think you should be fine - your situation is similar to mine, just rush to get the paperwork together and there's no need for you to leave australia in December!

Went to the migration agent today. He really helped us out. Told us to apply soon as in next week and we'll be okay. He said as long as we had a genuine relationship together for 12 months is fine. And we've been together for 3 years genuinely. So yeah he said we'll be fine. And he's done many partner visas where couples only met a few times in a year. So I have more hope now not so stressed. Thx everyone!
