confused as which forms to fill in

Hi everyone as you can see Im new to this forum and I've read through a bit of it today and find some stuff very useful, I am an Australian citizen currently living in Ontario Canada with my husband who is a Canadian citizen, and we are wanting to move back to Australia as I have children back home who I am missing terribly, we will be moving back to Melbourne and living with my daughter and her partner until we are both working and settled, so my question is.......

1. Are we better off applying for my husbands visa's while we are still both here in Canada???

2. And if so what are all the forms that we need to fill in, as the more I read on the Australian Immigration site the more confused I become

3. And because we both work here in Canada and we will be both going to Australia at the same time will it be a problem with us not having jobs back home in Australia

I have only been here 2 years so I never took Canadian citizenship so I dont need to do anything other than fly home with my husband,

any help would be appreciated

It's probably best that he apply while you're in Canada, cheaper for oner by about $820 and possibly processed quicker too but more importantly, you do not need a testy time on arrival re visas being used only for their intent, ie.,
First of all you would need for hub to come in on a visa that did not have a No Further Stay condition, the ETA being best - Electronic Travel Authority (ETA) - Online Applications as tourist visas can have the NFS condition applied.
An ETA online application may also have a question re intent etc. and could need fibs told about not coming to get married here and only to visit.
In getting an ETA, a few different things could happen on his arrival:
. nothing at all , Or on being a might curious/intrusive an Immi guy could ask:
. Sir, what is your intended visit to Australia for?, and so then it could go in any direction, best being another fib as response and no pursuance if hub and you are good at fibbing [ and what of household goods and hubs documentation re birth, employment records etc. ]or worst being well, this is my wife and I am going to apply for a partner visa!!
. that could result in:
Sir, you did not really tell me that I wouldn't be telling anyone else either right now.
Sir, did I hear you say you are just here to see how Australia is.
Sir, what you're doing is not in accordance with how it should be done but?
And I'm only really joking for I do not think too many Immi guys do!
Sir, the ETA is only intended to allow you to visit and as such we will have to refuse you admittance to Australia.
We'll organise the first flight back to Canada for you.
Even worse still could be attempting to fib and getting caught out!
So applying in Canada is a far better idea eh!

As to the forms, have a read of Partner Visa: Offshore Temporary and Permanent (Subclasses 309 and 100) and being married waives the 12 months relationship requirement but you still need to support your application so have a good read of eligibity and applying for this visa sections, including all links use the Checklist and also Booklet #1 for back up detail of what to provide.

An Immi officer in Canada will look at your overall situation as a couple re a grant of the visa and decide if an Assurance of Support is required but if both of you have a reasonable employment history and have finances, that is possibly not too likely.

And yes, you can fly back with hub once he has a visa.
