Applying for an onshore partner visa while on ETA

Hi everyone,

Hoping that I can get some advice.

My partner and I were recently married in Australia.
She is Malaysian travelling on an ETA (subclass 601) visa and has recently left Australia as her 3 months stay had been reached. The ETA visa should allow her to return to Australia multiple times within the year of its validity provided that each of her stays are for a max of 3months only.

I am wondering, is it possible to apply for an onshore partner visa if she returns to australia on her ETA visa?

Or should she apply for an offshore partner visa?

Would really appreciate any help or advice.

Does she have a No Further Stay condition on her ETA? If so, she cannot apply for an onshore visa so it'd have to be off-shore. But if she doesn't and you can provide enough evidence for the visa, there's no reason she can't apply onshore when she returns. It'd probably be best ot wait until near the end of her next 3-month stay so you have maximum time to gather evidence to support your application.

thanks for the reply. Fortunately she does not have a No Further Stay condition on her ETA.

We are gathering up all the supporting evidence now as well to help with the application.

I had one concern, that I couldnt find out online... what happens when she applies for the partner visa onshore - i.e. does she get a bridging visa of some sort while her application is being processed in the queue?

I was thinking that we should apply for her partner visa at the start of the next 3 month visit, but wasnt sure what happened in the interim, or if she still needed to leave the country by the end of the 3 months if the partner visa wasnt approved by then.

According to this thread.... http://www.australiaforum.com/visas-...equired-3.html .... if you apply onshore, she'd be given a bridging visa A which would take effect when the next 3-month visit ends and she doesn't leave Australia.
