Between lodging my application now or waiting untl 485 is granted

Hi,

My case is a bit unusual, as this new sol and new immigration laws get me really confused, this is my case:

I have applied for a 485 TR visa on the 12 of march of 2010, as a Secondary School Teacher, with all the documentation attached and in order. This was as I got an IELTS of 7.5 overall, but 6.5 in the writing band.

The problem is that I was not aware that PR applications must be lodged 6 months after the completion of the course (11-12-2009), so I think I have to lodge my visa before Friday, otherwise wait until my 485 is granted.

I also haven't taken the IELTS test again, however I booked one for the 26th of June. I am afraid that, after the 1st of July the eligibility criteria change and I will not be able to lodge my application when my 485 is granted, so should I apply for the 885 visa now? or wait until such visa is granted?

Also I understand I have until the time a decision on the 885 is made to provide the IELTS, does that mean I have until then to take the test again and again until I get the score I need?

Ah, last question, if I lodge an online application by myself, do I have to get all the documents certified? or just to scan them

From what you have said there it seems
. You have gained a TA assessment to lodge your 485 application as TA did not introduce their 7.0 IELTS score requirement until 22 March and so for your application on 12 March you did not need the four 7.0s scores.

So have you actually got your TA assessment or have you just lodged with your 485 application evidence of seeking the assessment?

And are you relying a four 7.0s ielts retest score to get the additional points required for an 885 visa?

It would seem that attempting to rush the 885 application could lead to some problems for you as re What's New? Recent Changes in General Skilled Migration , though there is limited additional time for lodging an IELTS result [ and wording is a little vague in referring to time of decision ] it is clearly stated

So it would seem time of decision is being set at a maximum of 28 days from date of application, more based on a decision as to whether basic requirements are met more so than a full decision on the visa granting itself for visa granting decisions do seem to take far longer.

So your 26 June retest date is outside of the 28 days requirement based on that Immi info.

And rushing because of the new SOL is probably not needed in relation to points criteria so much I would expect.
The reasoning on the changes being introduced is more about prioritising by employer sponsorship and state requirements in lieu of the CSL and a subsequent revision of in demand occupations more so than reducing points available other than the revoking of MODL.

In fact, there have been some transitional arrangements made for onshore applications in respect to still claiming MODL points.
You ought to have a read of the annoncements dated 08February to see what's applicable to your own situation in that regard.

It is possibly also to your advantage to wait on the announcement of the State Migration Plans [ hopefully also produced in conjunction with new SOL publication but if not, not long after ] for you may be able to get a higher priority.

Agents Gateway – Emailing scanned attachments for GSM applications FAQs is in reference to agents emailing but for scanning documents it says to use if originals or certified copies.
I recall having seen similar advice re scanning for electronic lodgements.
