Is there anyone who could answer my question........... I have almost all documnets ready that i need to apply for PR. Only remaining is 7 band in IELTS however I have band 6 in all component. Since my course is not in new SOL list I need to apply within 30th June 2010 in other to apply under current SOL befor new SOL is effective.I have booked IELTS test for 26th June and I wont have the result until 10th july 2010.

As mentioned on immigration website we have time until the time of decision to provide of fulfill IELTS requirement i.e give the result with 7 band.Also at some point it is mentioned we have 28 days from the application date to give the result.....this is really confusing... what is the actual fact ?????? what is the actual time frame....and what do they mean by saying "you have until the time decision is made"????

Now, I want to apply for PR before 30th june with 6 band and try to get 7 in my upcoming test. But what i am concerned is...if i cant get 7 this time then will I be able to withdraw 885 and then apply for 485. As per the new rules I am eligible to apply 485. If 885 is rejected on the ground of my IELTS what would be the consequences??? MY student visa is due till the end of august this year

would appreciate if any one could help me with this dilemma

As I understand it, Immi are nominating 28 days from time of application as being date for decision in regard to supplying a later IELTS score.
If you put in an application that's it and though you could notify Immi of withdrawing, you do not have a right to get fee refunded, that being entirely up to Immi and something that does not usually happen.
If your 885 is rejected and you are still eligible to apply for a 485 visa you could do so.
That would at least give you another 18 months so as you could seek employment and perhaps get an employer sponsorship.

You appear to have a number of options, however, this is a complex issue and I suggest you obtain professional advice based on your specific circumstances.
