Citizen Family Relationship (461)

Hello, I'm new to the forum, but I would like some help before I apply for a 461 visa. I'm from the uk but my half brother is from New Zealand (same father) my brother has been living in the uk for a number of years now, but still holds a New Zealand passport and he is going to Australia, and I was wondering if he can sponsor me to go to Australia. I'm 32 and have had a holiday working visa about 10 years ago, I know that means nothing but that has the only visa I have had and applied for in the pass. If anyone can help that would be great.

Do you meet this criteria?

"You must be related to the New Zealand citizen as either:

• their partner
• their (or their partner's) dependent child
• the dependent child of their (or their partner's) dependent child
• their (or their partner's) relative who:
◦ does not have a partner
◦ usually lives in the New Zealand citizen’s household
◦ is dependent on the New Zealand citizen."

I don't know much about this visa so can't offer any other guidance.

Hi Steve,

I am a New Zealand citizen and I am also trying to figure out if I can sponsor my brother( He is a South African passport holder) to join me in Australia. I think the 461 visa might do it, but i am not sure. Have you find out yet if brothers and sisters are entitled to this visa? Thanks.

The post right above yours answers this. The only way they'd be entitled to it is if they are completely financially dependent on you, which can be very difficult to prove if they are adults who have not remained continuously in school. You may want to have a chat with a migration agent if you think they might qualify as a dependent.

Thanks for the reply. Well, it is not very clear. What do they mean by dependent on me and usually residing in the same household? My brother lives under the same roof and was dependent on me for many years up until a month ago.

As a New Zealand citizen i am aware that i can live and work in Australia, but what option would my brother have to come with me? Would he have to get a visitor visa and try and find a company to sponsor him? He graduated with a Bachelors in Quantity Surveying.

Any idea what options are available for him to join me when I head to Australia? Thank you.

His only option if he is no longer dependent on you is going to be getting a visa on his own merits - getting a company to sponsor him, as you said, or getting a skilled PR visa.
