hello everyone..

my name is Lana and me and my boyfriend have been together for over 3yrs, i'm 17 and he is over 18. He had to go back to his home country in Mauritius. I'm going to go see him at the end of this year but we are a bit confused about all these visas and which one he should apply for. I've done hours upon hrs of research and am not sure of which visa he should apply for. I was looking at the De Facto visa but it says as a requirement that you have to have lived together prior to the application, but that obviosuly isnt possible as he is in another country, and im not sure if that would be taken into account.... does anyone know?????????? ... I was also looking at the "Prospective Spouse Migration Visa" .. does anyone know how long this visa goes for and what happend once it is approved? .. If anyone knows another visa that could help us out that would be great because we were not intending on getting married and that's why we were looking at the De Facto visa... anyway... any help on the things mentioned above would be much apprecciated.

The PMV is as the name implies for those planning to marriage and there are age requirements as well - Prospective Marriage Visa (Subclass 300)
The defacto does as you know have a relationship requirement so to sponsor on that basis you would have to look at how that could occur.
It'd seem you're looking at some time into the future and he getting a student or some form of skilled visa to come to Australia again as an alternate to not intending to marry.

Can he aply for the PMV because im 17, although within the 9month time of when we would have to get married, i'll nearly be 19???? ... I don't think he is able to come on a student or work visa because he already was on that when he was here and then he extended it. so basically he's already been here twice on that... he cant come here again on those terms, can he????? well i don't think he can and that's why we are loking for alternatives... can anyone think of any alternatives to help us out???

Hi Lana,

I don't think there is a limit to the number of times he can get a student visa. If he meets the criteria he should be able to get another one.

As you have realised, you would probably not be able to get a de facto visa since you have not lived together at all, despite being in a relationship for such a long time.

Maybe he could get a tourist visa to allow you to live together for some time, or you could even get one to live and travel over there? Or, what about internships? Being students, I'm sure you could get one through your uni or even a private agency, for a fee of course. Volunteering may be another way...

Appart from a student, tourist or skilled work visa, there are not really any other options in visa categories for you two unless you can live together first.
