Initial Entry Date Requirement for Offshore partner visa (309)

Hi everyone.

Quick question about the initial entry date requirement for the 309 visa.

My partner got all her health checks and police clearances in November last year. We only got around to submitting our initial application online this month (Jan 12th). These checks/clearances have already been submitted online on our immi account.

It will be processed by the London office where we have been told its 8-9 month wait, which is fine by us as we do not plan to migrate until 2015.

As her health checks and police clearances will expire in November 2014, approx 2 months after our visa is expected to be granted, she will therefore have to enter the country before this expiry date.

This is not ideal for her, so my question is, will they accept new health and police checks, in a couple of months time, which would possibly extend our initial entry date till early 2014.

I have tried asking this question to my CO who came back with a very blunt answer Refer to the attached FAQ which doesn't really answer the question of if they will accept new checks, even though my current checks will still be valid to get through the application process.

Before I bother my somewhat unapproachable CO again does anyone have any light they could share on this.

I had a similar worry with my application, which ended up being granted well before the estimated time so I was okay in the end. You shouldn't bank on that - it probably will take the estimated time or longer, but your CO will let you know if her health or criminal checks need to be renewed and will accept them.

I've been told that submitting new checks to extend your initial entry date is not an option. Not sure if that varies by embassy or not. I've never heard of anyone doing it successfully at any embassy, though. You're going to have to deal with whatever initial entry date they give you, though be aware they do *usually* try to give at least 3 months, even if checks expire before then. Usually, but not always, so be prepared either way.
