Prospective Marriage Visa-Help Please

Hi

My UK partner and I are wanting to apply for the PMV....we meet all the requirements regarding our relationship and proof of it etc, but after a long wait which was out of his hands, his divorce is finally going ahead.

My question is........can we still apply for the PMV while his divorce is going through the court system/procedures or should we wait until his divorce is finalised?

I know we both need to be "free to marry" for the PMV, but thought if we could show some proof that the divorce is going ahead, then that may be OK?

Any advice or a reply from anyone who has been in a similar situation would be greatly appreciated. We've been apart for far too long!!

Thankyou

In the applying checklist there is reference to whether there has been a previous mariage and divorce, so I suppose if you supply one but not the other it could be a problem.
You also need to supply some advice re marriage arrangements and you could probably at least get that organised in taking something of a punt in allowing for a marriage say six/nine months ahead from when you expect the divorce to be finalised.
If you have the application/sponsorship all ready to go and he even gets the medical and police check organised for about when the divorce is to be finalised, you'll at least be expediting the application.
