Refused Partner visa, now applying to MRT

HI all,

I am Australian and my husband is not, we applied for his partner visa which got refused in Feb 2013, so we applied to MRT in Feb 2013 and have now received a letter of invitation to present our case before the MRT in April 2014, but we have just sent through all our paperwork and believe its enough to get us a decision in our favour.

Has anyone been approved by MRT just based on their document evidence even through they have been asked to present before the MRT?

Update!

So i got a call from MRT today to say that tey have decided to cancel our hearing for next friday and that they will make a decision based on the documents that we had sent to them back in February this month. So we are taking this as good news right, i mean if they weren't satisified with the information and evidence of documents that we had sent them then they wouldn't cancel because there would of been things that they would've wanted to ask us, so i asked the lady on the phone how long we'll have to wait till we hear back from them and she said it should be before next friday !!!! so we have high hopes that this means our case has been remitted !!!! We shall wait to receive the letter in the mail so that its official!!!

Hi.
My husband and I also initially got refused. He was from the subcontinent. I think you should just apply again and work on the points that they refused you for. It took 2.5 years but he got a visa. We have been married for 11 years and have a son.

Congrats! You are right. If the tribunal was not satisfied with your evidentiary documents, it has to invite you to attend a hearing. So your case will be remitted after the day when the tribunal hands down its decision. I do not know how long it will take to remit the matter from MRT since in some court, only a remitter alone takes three weeks or even more!

You got to remember that a remitter is only a remitter. So after that, I do not know how long you have to wait for a new decision of the DIBP. It should not take too long in any event (but 'should not' does not mean anything when it comes to immigration in this country).

A migration agent with many experiences in this area such as Mark Northam might be able to tell you the estimated time. Hi Mark. Aren't you reading this?

UPDATE!!!

We are so over the moon to share with you our good news !!!!

On the 1st of July 2014 we finally got the email we had been anxiously awaiting for 3 months since we had heard from MRT that our case had been remitted and didn't need to attend the hearing... My husband was granted his 801 and 820 visa now we can happily close that chapter of our lives and move on

Thank you to everyone on here for sharing your experience and advice and i wish you all the very best.

Can i ask what date your husband originally applied for visa? I am desperately trying to work out whether I am going to get the 801 or not. its been 22 months since i applied and my case was remitted yesterday!

Go through your refusal letter and note down all the issues which visa officer put in his / her letter. This is just the beginning.

Collect all the evidence to justify a genuine relationship.
