Hi,
I find there are 2 chances to apply visa for spouse & kids. One way is by associating them with my 189 application and the other way is applying 309 provisional visa, after i receive my PR. Due to financial constraints, I plan to apply visa for dependents later I got a job there in Oz.

I have a query about the the equality in rights of visas applied at both stages. In simpler tone,Will the dependent receive the same rights for both the visas, as it is applied at different timeline.

If the dependants are included in the sc. 189 visa they will all be permanent residents once the visa is granted.

If they are sponsored on a partner visa they will initially be on a temporary (provisional) visa until stage 2 of the partner visa application has been completed. They might be able to get a waiver of the 2 year wait if you are in a long term relationship.

Thanks for your response sir.
We have been in married relationship for 4 years and applying from India.
Any possibility that I could apply for subclass 100 straight away for my wife and kids.

You apply for both the 309 and the 100 at the same time. You can request a waiver of the 2 year wait requirement, because of being in a long term relationship, when you lodge the application. It is at the discretion of the case officer if they want to grant the sc. 100 straight away.

Thanks a lot for your prompt answer, which I have been waiting for days.
One last question. If a 309 is granted, then I guess they reserve the same rights as PR for 2 years. However will the employers consider it less compared to a PR, as there is a decision pending for PR lately.
I understand this is based on employers, however is there any general behaviors like that.
Do you know something about it.

I have heard stories that some employers will only employ permanent residents. I have no personal experience of this, but maybe others on this forum can share their stories ?
