Angry Visa Rejected today please help

Hello
I was so happy to reach the final stage of my visa application at the end of the year and eagerly awaited the case officer being applied. Today I got an email saying my Visa is rejected - is there anything I can do ?

Visa - 190
I received invitation from VIC governement
completed medical and police checks all fine
Computer society assessment completed successfully. I have worked in IT for over 10 years however this now becomes an issue at the final stage of the assessment as they do not seem to consider any of my jobs pre 2010 as applicable.

I am completely devastated as I now do not have the points and the visa is rejected

I quote from the rejection
'Your skills assessment from ACS determined that your employment from October 2010 is considered appropriately skilled and relevant to your nominated occupation. ONly employment from this date can be claimed for employment experience.
Considering this I am not satisfied that you were employed in your nominated skilled occupation, or a closely related skilled occupation for at least 96 months in the 10 years before the invitation for this visa.
However I am satisfied that you were employed in your nominated skilled occupation, or closely related skilled occupation for at least 36 years in the 10 years before invitation for this visa and 5 points are awarded.

wait you lodged the visa application before completing your ACS assessemnt? If not and you had the assessment already done then you should have known that you're not getting points for all 10 years that you've worked.

How far short are you now on your total points?

For engineering professions, EA has what they call Competency Demonstration Report (CDR) where if you have non-recognised qualifications that you want them to assess, you file CDR along with your entire professional history to highlight your relevant skills & experience. You can check to see if ACS allows similar approach.

thanks for your response.

I completed my ACS assessment last year - it was possitive outcome -

I have ten years of references listed along with my online 190 application but appears the case officer did not read them!
Therefore they did not give me the points allocated for 10 years of experience. They only awarded 5 points!

It also appears despite the fact I have a Bsc degree and a masters they are saying they do not recognise my BSc degree. So I lost further points becuase of this!

They say I have 45 and I need 65

I think the best thing is to get my case reviewed by a migration agent and decide if its worth appealing it. The appeal will cost 1800 dollars.

The immi account - never showed a case officer was assigned the first notifcation I got this morning was a decline unsuccessful email. Immi has not updated at all.

Its very hard news to deal with

You need to get an immigration lawyer. May I ask what month you uploaded your police and medicals, and what month did you apply for visa. You should have a co who should acknowledge receiving your documents. You have a case here.

Hi! thanks for your response Kene

I uploaded everything on
30/12/2013 - on the new 'immi' system following my Expression of interest from Vic state for the 190


I completed the Health check and police check around end of Jan 2014 - I decided on my own to conclude all the information required and in this case that may have worked against me including additional cost when it was not granted. Perhaps I should have waited.


I was never informed that I had a case officer or any kind of acknowledgement
- My Immi account has not changed at all in fact it is still at 'in progress'
however the Decision record was sent to my hotmail this morning.
It was a bit shock, Now I am not sure if I will be throwing good money after bad. Since the appeal cost is high.

truly sorry about your loss of money and this tragic result but it seems you kind of rushed into lodging the application without first understanding your ACS outcome.

ACS employ rather complex strategy to assess skills. They take out a chunk of 'years of experience' to satisfy the Skill Level Requirement Met Date which will not count towards Skilled Employment. And for immigration purposes, you get points according to Skilled Employment. So you should have looked in your ACS assessment to see how many years they've awarded you under Skilled Employment and that's exactly what your CO did. They don't go by your own listed professional experience.

At this point, appealing would be a costly risk with no obvious benefits because ACS report is what ultimately decides your Skilled Employment points.

And lot of times, COs decide to play God, they don't announce themselves, they don't communicate with the applicant at all till the end. Don't sweat the small stuff.

Hi

Thanks for responding - yes I think you are right - at the time I was using a migration agent and I had limited experience in the whole process - they never advised that there was any issue with the assessment being only as far back as 2010 despite working in IT since 1999.

I guess there is completely nothing I can do now.
Unless I go back to the ACS and begin the process again

I am sorry for the sad news you received. I don't think going for another assessment by ACS will help at this time because they will still recognise only your employment years from 2010 which they have awarded 5 point on because it is up 3 years but less than 5 years and from 2010 to now may not be up to 5 years which will fetch you 10 points.

You also mentioned that they did not recognise your BSc, did they give you reason for that?
