Form 80 - employment

Hi all,
have been wondering about the beloved form 80 and what on earth happens to it once submitted. We have applied for a temp or perm de facto visa for my partner via Brazil. We submitted Form 80 when requested which was when the CO was assigned. My partner is Argentine, i'm not sure if that is a HR country or not... I found a list of country categories based on the health check and Argentina is a Medium Risk country, I don't know if that applies to security also.
My partner only holds Argentine citizenship, he has not lived or even travelled outside of Argentina in the last 10 years. (he's never lived outside of the country at all in his life). His parents and 2 siblings only hold Argentine citizenship and none of them have lived or travelled outside of Argentina in the last 10 years. So that part seems simple enough.

Just wondering about the employment. In Argentina about 40% of the working population are in employed 'en negro' or completely off the books. My partner falls into that % and almost always has. We listed those jobs, but how can they verify them if he was never listed as an employee? If they even go as far as to call these employers they'd never give any details of him working there as it is illegal and they can be shut down for having employees 'en negro'.

Does immigration even verify the employment? We were a bit unsure of the dates also, we gave rough estimates and hope for the best.

Anyone able to shed some light on the employment part of Form 80?

Thanks!

Hi Desde

I was interested to read your post, cause a similar situation is going on with my husband's Form 80! He's from India, and also only has ever lived and worked there.

Same as what you say, many, if not most of his jobs can't be verified for the same reason that in India, you just get cash in hand in many places, especially in the restaurant and construction industry. He also couldn't remember exact dates and had to estimate for the past ten years. He was never given contracts or payslips or any paper work.... Most of his employers didn't even have a telephone number and several of the restaurants have changed hands, been closed down, etc...

We don't know how, or even if, the immigration department are going to verify his work history!

So, what does happen with the Form 80 employment history section??

Hi Skydancer,
it's anyone's guess I suppose. I'm hoping the fact that his whole family only have Argentine citizenship and haven't even left the country at all in the last 10 years, all of his studies were done in Argentina, along with the fact his police check is completely clean that HOPEFULLY they won't need to verify his very harmless sounding jobs. Actually I hope they don't have to get the Argentine authorities to verify anything at all because that would be a guaranteed extra 6 months on our processing time! Anything that bureaucratic is a disaster here!

Same here. His whole family have never been out of India, and his police record is clean, and his jobs are all normal harmless ones....

Wish both of us a very happy and quick result

It could be that the Form 80 will be requested for any HR countries not based on medical issues but just because the blanket categorisation is that countries for which ETAs are an option are the LR ones.
There can also be some variations country to country in the approach that immigration people in those countries take and though it is quite likely that additional security checks may occur for countries in the middle east/north africa etc. where there has been significant conflict issues, there'll be a number of countries such as Argentina that may fall into the HR category but there is no direction re extra security checks or a direction re level required.
I think there have also been a couple of posts re Form80 being requested for LR countries and sometimes not for HR and then one immigration solicitor posted it will always be asked for though if that was the case you would have thought that requirement would be in the regulations.

All anyone can do in filling out an application and any other forms is just to put down the facts and always a good idea to keep a copy of an application and any forms so that where there are circumstances such as in Argentina or India, consistency is maintained.
Local Immi people should have a good appreciation of the local economic/employment situation.
