Does my wife need to change her surname to migrate here?

Hi, Ive been lurking here for a while reading everyone's advice on migrating her but now I need to ask something directly.

I married a philippina here (australia) several months ago and we have yet to lodge the migration application due to nothing but trouble with philippino government departments. They wouldnt recognize the marriage extract I got from births, deaths and marriages. Then she went to the australian embassy in manilla and got a letter from them recognising it. Still not good enough.
Then I got it certified by the consul in adelaide. Still not enough. I got the consul to write a letter endorsing it and then did a report of marriage so we were recognised. Now 2 weeks later theyre still giving us trouble unless we pay another fee over there to speed things up.

Now all of this was because she wanted to change her surname to mine. But. Is it necessary to migrate here? Because if not she can put the papers in tomorrow, shes still got her current passport. Its just im getting extremely frustrated with her government and I havent told her that Im starting to despair a little over all the roadblocks they keep throwing up.

Hi Marcantony,

Sounds like you've been on a wild goose chase - I can understand the frustration!

But, no, your wife doesn't need to change her surname at all. As long as you have evidence of your marriage and shared life, it's not a problem to have different surnames.

Yup, there's no need to change surname to file for that. If she wants to change her surname, she can do it after the PR.

Just be a bit more patient. The one good thing is the expedite fee gets things a week or so earlier (depending on what it is). In others, you can't expedite anything.

thank you for you replies

We are proceeding now on using her current passport. The government department there made one last attempt to get money by telling her if she didnt pay she wouldnt have any protection in Australia if I turned out to be abusive and the philippino embassy wouldnt be able to help her. God, the garbage they were making up. And she told them so too.

Now we can finally lodge her papers with the Australian embassy.
