416 and 442 visa application

Hi,

If I go to Aus on a 416 or 442 visa can I apply for a sponsored PR 886. I finished my 2 yr studies in aus in Dec 2009. I have my skills assessment, IELTS and criminal check and all other documents required. I pass the points score as well and my profession is on the ASCO list.

What are my options?

It is now the ANZSCO codes that are being used and your occupation will need to be on schedule#3 for family sponsorship or schedule#4 for state/territory SMP sponsorship [ when SMPs get established ].
Details @ Skilled Occupation Lists (Formerly Known as Form 1121i)
With family sponsorship, the sponsor also needs to be an Aussie Cit./PR or eligible NZ Cit.

My skill doesnt show on the sched 3 list but it shows on the sched 4 and ENSOL list.
I have my sister who is a citizen in aus and has moved to melbourne recently.

How does state sponsorship work?

Have a look @ Skilled – Sponsored (Migrant) Visa (Subclass 176) and it may be the 176 you need to look at rather than an 886 for eligibility for that requires you to have finished your study within the last six months.
Under eligibility you'll find state/territory links and though they do not currently have sponsorship active, as soon as they get sorted with introducing the SMPs you'll be able to check if your occupation is on a plan.
