Hi all...

I have a question on my eligibility to sponsor my partner on a spouse visa.

Im an Australian divorcee who previously sponsored my former wife to come live in Australia. In 2006 she came here after being granted a spouse visa. The relationship broke down rather early and later in 2009 we divorced (note: after permanent residency had been granted). Since 2008 I started a relationship with my new partner. We intend to get married in Australia and apply for a visa so we can live here together. She is currently on working holiday in Australia.

Am I eligible to sponsor her to live here? I understand there is a 5 year rule if the prospective sponsor has sponsored before, but can that be waived in this circumstance (or under certain conditions)? When does the counting of the 5 years start?

Any help would be nice.

There are some circumstances for waiver listed on Partner Visa: Onshore Temporary and Permanent (Subclasses 820 and 801)
I'd say the five years would be from whenever the visa was granted but you could ask whether an application could be submitted five years from when the previous one had been submitted.
Is your new partner able to do three months regional work or WWOOF Australia Official Website to get a second WHV and perhaps get your relationship out beyond the two year period which could also allow a waiver.
Alternately, are other visas possible, for instance if she has qualifications has she considered looking for an employer sponsor, or perhaps she could leave for a short trip out at the end of the WHV and return on an ETA.
