8503 Partner

Hi all

Situation - I met my current girlfriend last year in England. We lived together for almost 1.5 years in England (I am an Australian citizen). My girlfriend came to Melbourne a month ago on a tourist visa. We just found out shes pregnant (4 months along). I want to sponsor her for onshore partner visa but she has a 8503 condition. I understand that pregnancy isn't sufficient to waive an 8503 condition but does this change if it wasn't conceived in Australia and she didn't know when applying for the tourist visa?

any answer will be helpful

The regulation states :

Since the person was granted the visa that was subject to the condition, compelling and compassionate circumstances have developed:

-over which the person had no control; and
-that resulted in a major change too the person's circumstances.


I think you would find it had to argue that your partner's circumstances would satisfy these requirements, so you may have to prepare yourself for having to make an offshore application.
