Exclamation Schedule 3 Criteria

Hi Everyone, just need some help regarding Schedule 3-Compelling Reasons notice we received by Immigration.

I am an Australian citizen and got married in April 2012, My wife's student visa ceased on 22/04/2010, and wasn't holder of a substansive visa after that. She lodge the case for MRT and her case was decided in around November 2012, she lost the case, we had 28days to apply for Sponsor visa, and we lodged sponsor visa in December 2012.

today we received this letter asking for more information,

Criterion 3001 doesn't apply for us, as we only made an sponsor application in 2012 December.
other compelling reasons also doesn't help us, which is children from Aus Citizen from the relationship and long-standing relationship (min 2 yrs)

Immigration asked us to provide them compelling reasons in order to waive the Schedule 3 criteria. what kind of reasons are compelling to provide in this situation?

Also they are asking for Police certificate and AFP National Police Check, although we have sent it in the time of application to them. do we need to send it again?

Pls provide some help regarding this matter if you have any experience, really appreciated. thank you.

I totally agree. These matters are way too complex to be dealt with on a public forum. Partner visa applications get routinely refused because people fail to address the schedule 3 requirements properly. It is impossible to advise you without having access to all the facts and thoroughly researching the situation first.
