Exclamation Am I an eligible New Zealand sponsor for my partner?

Hi all! We are new to the forum and are thinking about moving to Australia for reasons of better climate/more job opportunities.

I am a New Zealander and my partner is British. I sponsored him into New Zealand a couple of years ago, he is in NZ on an indefinite returning resident visa. In 3 years he will qualify for New Zealand citizenship so we know we can move to Australia in 3 years time.

Just wondering if we would qualify for an Australian partner visa to move sooner? I'm not sure if I am an eligible New Zealand citizen? I have never lived in Australia before.

It doesn't sound like you are an Eligible New Zealand Citizen - basically you needed to be in Australia on or before 26 Feb. 2001 on a Special Category Visa to be one.

But as an NZ citizen you'll still automatically get a Special Category Visa when you enter Australia and you can sponsor your partner as follows:

"If you come to Australia on a Special Category Visa but your family are not New Zealand citizens then they can apply for a Subclass 461 New Zealand Citizen Family Relationship temporary visa (“SC 461”)."

Many thanks for the info provided above. We may be best off waiting for his NZ residency to come through. 3 years is a long time!!

You may want to check with the NZ immigration regs re whether he can still qualify for NZ residency by virtue of you still being together for that is usually the test and because NZ/OZ have the cross Tasman agreement, he may still be able to apply for the 461 and still get NZ residency.
