Prospective Marriage Visa Questions

Hi everyone

Just got a couple of questions relating to the prospective marriage visa. I appreciate any help in relation to the quesitons.

Firstly, my fiance and I have been dating for 5 and a half years and are in the process of applying for a PMV to Australia. I am a resident of Australia and have a job starting in January. Both of us currently live in South Africa. So my questions are:

1. The processing time for the visa is extremely long and it could mean I won't see my fiance for a month or two. Is there anyway of speeding the process up?

2. Is there anything general about the PMV that people tend to forget to do or include with the application?

3. How detailed must our and our family and friends statements about the relationship be?

4. In both form 47SP and form 40SP it asks my date of arrival in Australia. Is it when I first entered Australia, when I received my residency or when I am going back to Australia? (Q50 and Q26 respectively) (NB Question!!!)

5. Is my residency visa, sub class 856, a "contributory parent category visa"? (Q61, form 40SP) I received it due to my mother moving to Australia.

6. In form 40SP, they want details "About your home". Is this my home in South Africa or the one I intend to stay in Australia, i.e. for now my mom's house in Australia? (Part E)

7. Under the question of "your current address" it asks if the address is not in Australia, that I should attach a statement on how I will meet my sponsorship obligations. What should I state in this statement? (Question 30)

Hi jonty

I'm going through the PMV process right now -- I've recently submitted an application for my brazilian partner.

1. There is no way of speeding the process up -- except by having a comprehensive & well presented app (ie long enough so they don't need to ask you for any further info, short enough that they don't have to spend ages searching for info). Also it will help to organise your police certificates & medicals before they ask for them, ie frontload your app. Other than that, there is no reason/request you could possibly give them that they would speed it up for you. Sorry!

3. The statements of friends & families do not have to be terribly detailed/long, as your statement & your partner's statement will have the big story of the details of your relationship. But you need to remember that your friends/family can ONLY submit their statement on the form 888. DIAC won't consider it otherwise. You will see on the form that it is quite short & the space is limited & this is deliberate -- ie so your friends/family get straight to the facts & don't rabbit on -- they just need to confirm that they know you both, know when/where you meet, how much time you spend together, what shared interests you have, & that you're committed to future together. Also you only need a maximum of 4 statements from friends/family. At least one of these should be from a family member. Your partners family/friends could also submit one, but if they're not Australian citizen or have PR, its not going to have much weight at all (but it is good to show that his/her family is supportive of the relationship).

Maximum of 10-12 printed photos. Don't submit CDs of photos. They won't look at it. Its helpful if you can get photos that have the datestamp on them.

7. I would suggest you write that you already have an employment contract in place for when you return to Australia (& include copy of this in your app)

For everything else, it would be best for you to call the consulate or DIAC here in Australia & ask them directly about how you should interpret the questions in relation to your specific situation.

Talking about police check in Brazil... how many they are? Polícia Federal, Secretaria da Segurança Pública...is there any other???

Hi Dr
There are THREE (3) clearances that brazilian nationals need to get:: the two you mentioned (Policia Federal, Secretaria de Seguranca Publica do Estado) and ALSO Justica Federal.
The first one (Policia Federal) you can obtain online & it is easy to get. The other two are more difficult & you really need to be in the country to get them in person.

We are in Brasil now...well, the 3 of them can be obtained on line....you got yours recently, dont you? was the option of getting them on line already available???

No, there didn't seem to be that option available when I was putting our app together -- and my partner is travelling back to Brasil to be able to organise them (& do his medicals) in the next few weeks. But if we could organise the police certificates now, earlier, that would be a weight off my shoulders! Can you post the links for the "Justica Federal" and "Secretaria de Seguranca Publica do Estado" police certificate sites? I'd be eternally grateful!!!!

i dont think this site allows you to post email addresses -- but i believe you can send private messages to other members through your personal account page?
my finance is from Bahia but is doing medicals in SP (which is ludicrously expensive!)
