Question I need help for spousall visa


I 'm under on my student visa, me and my partner started to live together last aug 2012, by the time his divorce was finalized in oct 2013, we got married in sydney last dec 2013. Unfortunately I could not carry his last name coz when i went to Philippine immigration they said that since my husband was married in the Philippines and they don't honor divorce but only annulment. Since annulment is too costly, an divorced is the only way he can be legally separated here in Australia. We just don't know what to do. I am on my process of submitting my spousal visa application,though we can really prove that our relationship is truly genuine, but i am bit worried since i could not carry my husband's last name on my passport. would that affect my application?
Should I still submit it?
Please help me...
