Hmm ok this is a bit confusing! I'm classed as a temporary resident on a 309 partner visa, not married, but visa does state indefinite. I'll probably ask qld transport before I go ahead but I'll probably just get it anyway as its not my car and want the owners to be comfortable that I am insured.

We were told ok for one year on kobo's international. Nrma were fine with that.

I am pretty sure that your visa is not considered permanent until you are a PR. I even consulted in the RTA recently as I am driving on the license from my country (and I have spent over 3 months in AU) until it expires.

FWIW, this is for NSW, I'm not sure if it's exactly the same in Queensland but I don't see why not.

Basically, on a 820/309 visa you are considered a "provisional" resident, which is still temporary to them.

Checking the Queensland website, it does say:

"You will need to apply for a Queensland driver licence if you:

are an Australian citizen and you have been residing in Queensland for 3 months
are not an Australian citizen, but before you took up residence in Queensland you were given a resident visa and you have now been residing in Queensland for 3 months
are not an Australian citizen, but after you took up residence in Queensland you were given a resident visa and you have now been residing in Queensland for 3 months since getting the visa.
A resident visa is a permanent visa or special category visa under the Migration Act 1958 (Commonwealth). These visas allow a person to stay indefinitely in Australia. These do not include temporary, business or guardian visas."

So it is not clear if you would even allowed to get a license yet... I guess your best bet is to go to the nearest office or contacting them on the phone (from my experience, emails are replied to with template responses that don't even cover my questions) and asking. Because you're from the UK (and I assume that's where your license is from), if you are eligible to get an AU license, you won't have to retake the tests, etc.

Hey guys, I called up the transport office in Brisbane today and explained my visa (partner 309, temporary resident but indefinite stay) after deliberation with her supervisor and someone else too they came to the conclusion that I didn't need to get the licence until three months after I became a permanent resident but I could get it now if I wanted. Turns out my UK licence expires in a few months anyway so I went ahead and got it, get paper for now and licence arrives in three weeks.

A good and sensible outcome. We did the same thing and got a NSW drivers license just before the overseas license expired. It is only valid for 12 months, but can be renewed for another year if needed. Still on Bridging visa A.

haha. Just as they had told me previously . My fiance has to sit the drivers test since his isn't recognised here so atleast he doesn't have to worry about that for another 2 years or so
