Partner Visa/Prospective Marriage Offshore From US?

Hi Guys

I need some help as we have a tough case and I'm trying to get some ideas!

My Girlfriend and I have been in a relationship for almost 1 year.

In that time, we have lived together at my parent's apartment for 3 months, and in a friends place (with a basic lease) for 3 months, then her Working Holiday visa expired and she had to go back to the US.

I have been to visit her 3 times for 10 days each time, but my business that I run here, doesn't allow me to leave to go and live there for extended time to get our time up to the 12 month co-habitation requirement.

We have tons of receipts, we traveled to Italy together, photos, friends statutory declarations and a joint savings account together (that we're saving for a deposit on a house).

We didn't keep a whole lot from the first couple of months of our relationship, as we didn't think this was going to be an issue (she was going to be sponsored by her work but they didn't meet the requirements)

Does anyone have any ideas on our situation? or ideas on where to find a good migration agent?

From what I can see our options are -

1. Apply for our relationship to be registered in Victoria (she lived here for 18+ months and has proof of this with bank statements and leases) although she is now back in the US.

2. Prospective Marriage Visa - I genuinely want to one day marry her, but I don't want it to seem like it's just to get a visa so would prefer to try De-Facto if we have a shot at it...

Does anyone know the usual wait times for a US Citizen, applying from the US with no criminal or health issues?

Well your partner will have to get the criminal checks. The FBI check can take up to three months to recieve. After your partner gathers all evidence, criminal checks, and had the medical exam send it to Washington D.C. In the USA it takes any where from 2-6 months. It depends on your situation and how well you put everything together. My application was approved in almost five months, but I waited to do my medical exam. I applied for a Prospective Marriage Visa.

Honestly you and your partner can do this without a migration agent! I did!

Yep, forget about the relationship registration with her not here and without that solid 12 months together or at least the better part of it and acceptable reasoning for a temporary separation, it is really she gets student or long term tourist visas or an employer sponsored one to return or it would seem to be the PMV for you.
