Advice needed please?

Hello,

This is my first post
Hopefully I'll be able to get some good advice as I don't have a clue where to start!

I'm 30 years old, live in the UK with my partner and 1 year old Son.
My partner is in the final year of her Nursing Degree, her course will finish next September.
I work for my Mum's buiness and have done for the last 4 years, it's catering and although I'm in Management this does not boost my chances of a Visa?

We are seriously thinking about moving to Australia and setting up a new life.
My Brother went to Brisbane over a year ago on a working holiday visa, met a girl, fell in love and they have just had a baby (Monday actually!)
He loves it in Brisbane and we want to go out also.
What Visa would we apply for? Through my girlfriend being a Nurse?
Does the fact that my Brother has been given residency help also?

We have no idea where to start with this and the idea is in it's early stages.

Also I have some past criminal convitions in the UK
I have a caution from 12 years ago (but doubt that will show up?)
I also have a conviction for an assualt which happened 8 years ago in May although the sentance was given 7 years ago in May.
Something I'm not very proud of, it was a stupid moment of drunkeness on a night out which I paid the price for. I got into a fight.
I was given 6 months prison sentance, which I served 13 weeks of.
I've had no more convictions since, not even a motoring offense.

We want to go and start a new life, the UK is too cold! (although that's not the only reason!)

Any advice would be much appreciated

Start with having a read from Workers - Visas & Immigration the top two heading links being the alternatives.
Medical professionals including nurses seem always to be in demand and you will find a Skilled Occupations List reference as you follow the steps from the second heading, there also being a Whats New Link at the top of the next page from the second heading and there are announcements there on recent and proposed changes re processing priorities and eligibility assessments.

A lot of nurses use the employer sponsored temporary residency 457 visa approach you can read about via the first heading and though that can then lead to a permanent residency sponsorship or alternately some nurses will on a temporay residency visa then put in an application for an independent or state based SMP permanent residency visa.

The first step in either case will be for your partner to get her qualifications approved via. Welcome to the Australian Nursing and Midwifery Council Limited (ANMC) | Australian Nursing and Midwifery Council , 12 months experience being a mandatory requirement for independent skilled migration and you and your partner can read what the new eligibility requirements will be under the Whats New Link and having experience will no doubt also aid any seeking of an employer sponsored visa in the first place.

So you'll have two or possibly three winters to bear though what you hope for can happen.
You and your son can be secondary applicants on your partners application and in being together a few years and having a child, all of you would get whatever rights/residency your partner is granted.
Criminal convictions where a custodial sentence of 12 months or more have occurred do mean a person will be rejected so fortunately you are under that bar though it will not be entirely overlooked and whether or not you feel any past infringements will be on the record, you should still be completely honest in revealing whatever is asked for.
