VISA 176 Help

Hi Australian Forum

I lodged my graduate visa february 2010 (subclass 485) and currently on a bridging visa. I am currently waiting for my state sponsorship. My lawyer stated that the best visa for me to apply for is a Sc 176 visa as I cannot apply for a Sc 886 or 885 visa as my Sc 485 visa must be granted first.

He also stated that the waiting time for the visa 176 can be reduced if he could lodge a decision ready application for me since all my documents are perfectly matches the criteria. (Probably 2 months time).

I am not sure about this. Can someone please advise me on this. Thank you very much.

I would have thought the agent would have been able to advise you appropriately and one poster did post here of success with a DRA by an agent some months ago and it did seem there was some priority being given for MIA registered agent submissions to the Immi Brisbane office I think it was for onshore visas, they being 885/886 etc.

There does not appear to be any official statement by Immi on the matter and it could be that it was a limited interim arrangement whilst the activation by states of their SMPs was awaited.

The 176 visa being a state sponsored one would want your application to be on an SMP for best priority, there being an employment experience requirement to be eligible, there being no bridging visa applicable to them as they are an offshore visa but if you still have a 485 application in, I suppose the current bridging visa you have will still apply.
You will have to pay an additional application fee and to have the visa granted if you are successful, you will need to take a trip outside of Australia.
You may want to double check on there being a DRA approach adopted by Immi, asking your agent in the first instance where they would submit application, online or not? and then you could also check the situation with Immi.

You of course need a state sponsorship first and you may find that states will either have sponsorships closed while they are finalising their SMP or with SMP established they are only sponsoring for occupations on the SMP and the states can have their own requirements to be met.

Thank you very much. Your reply mean so much to me. Thank you once again. Yes my agent also stated that I should be outside australia when the visa is granted. I am a social worker and I have got one year work experience and the SA state govt is still using the interim list which includes social worker. It is sad that I cannot apply for 885 or 886 while holding the bridging visa. I am not sure about this and that is why I am seeking your advise.. I will double check with my agent and will get back here. Thank you.

Hi Wanderer, How are you? I have lodged my state sponsorship on the 22nd of december 2010. I am waiting to hear the outcome.
