Partner Visa 309 /100

Hi

Like everyone else we are working our way through the paperwork and I have some queries that I hope I could get some answers for.

1) We were married 16 months ago have been living together for 25 months. and in a relationship for 3 years 2 months.

2) I am Australian citizen but we both been living in China since we were married.

My questions are

1) We decided to apply for a 309 but then discovered that when/if its approved we actually have to return basically to Australia within 30 days we hadnt planned to do that straight away all we wanted to do was get the paperwork sorted out and in place. Then I notice that we could possibly skip this stage and go straight to a permenant visa 100 is this possible.

2) Since I am living in China with my wife its simpler to do everything in her name its impossible to get a joint bank account for arguements sake or any account any suggestions about documentation to show we are sharing everything.

Also I would like to know is there a min stay provision when they grant visa does my wife have to spend a certain time in Australia if the visa is granted. I cant find anything on this

The part about needing to return to Australia within 30 days of the visa grant isn't true. Once the visa is granted, you normally have 12 months from the date of your medicals or police clearances (whichever is sooner).

As you have been together for more than 3 years, providing you can show this with evidence you will likely get the 100 permanent visa.

There is no minimum stay, but the visa is only valid for entry into Australia for five years. After this time, if you're not in Australia it expires and you need to re-apply. Resident Return Visas are available, but you need to show that you have been living in Australia or have another connection to the country (bank accounts, property, business, family) to be eligible to apply.

Not sure what the question is here?

This was to do with showing you live together and having joint bank accounts its next to impossible in China to do this so it all in my wifes name.



There is no minimum stay, but the visa is only valid for entry into Australia for five years. After this time, if you're not in Australia it expires and you need to re-apply. Resident Return Visas are available, but you need to show that you have been living in Australia or have another connection to the country (bank accounts, property, business, family) to be eligible to apply.
My problem was concerning that we need to travel back to China and stay here for several months at a time and there might be some condition were you have to be in Australia for a certain period of time for the next stage of the visa to be processed. if we had to do the 309

Certifying telephone bill

hi

can some one tell me how to certify my telephone bill.I want show that we have contact with other .

We use prepaid phone and we can only get the usage history downloaded from our account.

My lawyer said he can not do it because it is not the hard copy .

can you advise what can be done?

You can still supply the call history as evidence, it just won't be a certified copy.
