my experince with from hell with the department.

hi guys,we just went throught utter hell and i thought maybe sharing may help.SORRY ITS SO LONG!

went to deparment to change my partners add,he handed over his passport and it was checked,it showed a non compliance on it,(hes student visa)
they said he didnt attend tafe for a peroid of 6 months.
we know this is not true as we paid the money,tafe must send out 3 letters of warning then also give a 20 day right to appeal before they cancel a students enrollment in there classes.we never got any letters from the tafe.zip nada zilch.
we told this to the man in immigration and he did not care,he was soooo rude to us that i started to cry and he didnt clearly care.
he said hes cancelling my partners visa and we must go back the next day for a formal interview to have one last chance of speaking.

the next morning we headed to an migration agent.we were so scared and didnt know what to do,she was so helpful to us and said we need to lodge spouse visa before student one is cancelled,she closed her office down for the day and answered noone elses calls just to help us.
we had just 3 hours to do paperwork for spouse visa and gather all our evidence.it was hell trying to do it in that time,the agent was amazing and went to work super fast.
she went with us to the immigration and begged the guy not to cancel his visa untill we lodged a spouse visa.he said NO.he would not even hold off 30 mins and did it right away.we had no chance to explain our reasons for anything and basically were treated like dogs.he told my partner that he sees to many indian men in his office (my partner is pakistani) and cancelled his visa.our agent begged him to put my partner on a bridging E visa while we lodge our spouse visa,very very reluctanlty he said ok and put my partner on a E visa.
we then lodged our spouse visa.
had the student visa not been cancelled for 30 more mins it would of been so much better,but now coz its been cancelled even tho our spouse visa is in its going to be super hard to fight this.
we need to fight with the tafe ourselves as it cost 1400 to go through an apeal,after paying the 2580 for spouse visa and the 2750 for the agent we are almost broke and need to fight it ourselves now.
my partner is now allowed no work rights/study/or travel.he lost his job over this.had tafe told us in the first place they were going to kick him out we would of fixed it and not been going through this hell.
we are getting married in jan and sadley even that wont help,it may help oneday if hes back in his country and im his wife living here.
its a cruel cruel thing to go through and had we not had the agent we would of been screwed because you need to know how to talk to the department and we dont know how to.
this is the biggest battle of my life,its for the man i love and im going to keep trying untill we have the answers and outcome we need.

The lesson that is to be learnt from what you posted is very clear and that is:
Understand that regulations are legislated and any Immigration official will be breaking the law if they vary from them.
Secondly, understand the commitment needed for all regulations and that also includes adhering to conditions for student visas.

You may claim the Immi agent was rude but in fact he was probably stating something that did not appeal to you and yes, there could be many people from different countries attempting what they can to stay in Australia.
