Marriage failed, can apply for another Student visa?

Hi, every one here

My question is whether I can apply student visa onshore to finish my education after my marriage is over?
I am now on temporary spouse visa sub class 820, but after 1 years unhappy marriage, my Husband and I are now divide and decide to devoice on the February 2011, by that time my temporary spouse visa is supposedly be cancelled.
But before I got marriage on February 2009, I was holding the international student visa on full time basics. Since my marriage, my visa changed to 820 temporary spouse visa and no attending school any more.

Now I decide to continue my education after my marriage is over. But I don't know how to make me stay legally in Australia while I am trying to finish my education? Can anybody give me some advice?

Hi there,

First of all, I would contact DIAC and ask them what your options are of staying in Australia. You also need to tell them that the relationship has failed, if your partner hasn't done this already. If they don't know, and you don't tell them ,this is against immigration law.

You may be able to get permanent residency by yourself, but I'm not sure of this, so you need to speak to DIAC straight away.

Hi,

If you are no longer in the relationship your visa, as I understand, is now effectively cancelled. I believe you have 1 month to either lodge a new visa application or leave Australia. You cannot wait until your divorce is final to tell immigration. My friend had to leave after the breakdown of her relationship & she did not qualify for any other visa.

Bear effectively has that wrong and as aussiegirl says, contact Immi for there may even be a chance depending on conditions of separation that you may be allowed to stay and continue on to PR.
As for studying and getting another student visa, that is another visa application and you will just need to look at your eligibility and apply if that is the path you choose.
