Convert 300 to 309 visa

Just got a call from our CO saying we have the option of switching our PMV 300 visa to a 309 visa.

She said she knows we are apply for a tourist visa and we have a wedding date of November and she doesn't think the 300 application will be approved by then. She said we have the option to continue with the wedding as planned, then inform her afterwards and she will change our 300 to a 309 visa. This way she says we won't have to move our wedding date. She would still have to be out of the country when a decision is made, but the CO said she will let us know when that time comes so she can leave Aus. She also said the processing time (approx 10 months as of now) will not change from our original lodgement.

Of course if for unknown reasons a 300/309 visa is not granted and the tourist visa expires she would have to leave the country as well.

Has anyone going through this before?

I've seen this happen a few times. It sounds to me like this is REALLY good news! Usually COs offer this when they think you have enough evidence for a partner visa instead of a PMV - you may want to confirm with her. Just ask her something like "Will the evidence we've provided so far be enough for the 309 once we submit our marriage certificate?" I'd also suggest trying to collect financial evidence between now and then just to give them a sample of it, as well as stuff with your address on it. It's a bit like hitting the lottery to have this opportunity, lol. That means you won't have to go through a second application process, like you would with the 820 after you got married on the 300. Also, your countdown to permanent residency will start much sooner - as of the date you applied for the 300! Definitely take her up on this - this is great!

I might wait and ask her about the evidence thing. She also sent through a request for missing documentation. There haven't been much financial evidence though. All our accounts are currently seperate. And I've only mailed her stuff twice and used a agency to send her flowers on her birthday last year.

Oh by financial evidence now and then you mean when she arrives into Australia and afterwards? Ie future not the past?

Well thats easy then, we can open joint accounts when she arrives.

The CO has been talking about the 300 to 309 since the first phone call to her. Then she called today to explain the process to me. It felt weird lol, is there some catch hahaha

No, no catch! You're so lucky. :-) If she is not going to finalize it until after November, you can continue sending evidence to her for a while. Sounds like you got a communicative CO (lucky) so she'll likely tell you "enough" if you send more than she needs, lol.

Yea she's really quick in communications. I sent off an email to her about my missing documentation and she replied within 20mins.

My plan now is to organise our marriage certificate before they get the chance to make a decision. Switch over to 309 visa. Wait a few months save a bit more money, finish building the house then hold a formal wedding ceremony and reception.

Ill get in touch with our celebrant and see how we can organise all of this

Keep in mind that a partner visa application requires a lot more evidence of your relationship for at least 12 months in advance of the application, so be prepared to organise and submit that.

Actually, if it's a spouse rather than de facto visa (which it will be) it doesn't have the 12-month requirement, as you know, Maggie. The OP will likely need to supply additional evidence, but my understanding is that with a spouse visa it can be after the application date and is not a "time of application" requirement. I really doubt the CO would be suggesting this move if she didn't already feel the OP would qualify. It's quite possible she even already has all the evidence she feels is necessary.

It'd be different if OP were asking the CO herself to switch her 300 to the 309 - then I'd be much more worried.
