112 visa (Employer Nomination Scheme)

Hi There,

Im currently a defacto and my partner is on a 457 sponsored visa. The visa expires in November 2013. (she will have been in the position for 2 years in november)

We want to start looking at the permanent residency avenue now and her employer is happy to do the 112 visa (Employer Nomination Scheme).

Just a few question on the 112 visa :

1. Do we have to wait a certain length of time before we can apply for the 112 visa as we are now on a 457?

2. Once the 112 visa is granted is it possible for her to change jobs or does her new employer have to nominate position again?

Do you mean the 121 visa and if so it is probably the 856 you could possibly mean for the 121 is an offahore application visa whereas the onshore visa is the 856 - Employer Nomination Scheme (Subclass 121/856)

The 856 has different eligibility paths, one having been on a 457 for two years and an eligible approved employer who offers employment in a position that is considered to have a life span of at least three years, words to that effect being shown in eligibility information.

Once you have PR granted, your legal obligation to stay with the employer is really a matter of the letter of offer and any contract of employment entered into though if a trend starts up of people getting PR through the ENS approach and immediately giving an employer the flick, it'll not just be employers that could be concerned but I imagine Immi would review what is happening.

Hi, I would like to ask about switching employers when on a employer nominated permanent residency visa.

I came to Australia on an employer nominated permanent residency but the job turned out not to be what was promised during the interview .
However, my dependent spouse has been offered a permanent job that looks very promising.
Would it be possible to transfer my (our) PR to my spouse's name with my spouse's employer taking over the sponsorship to allow us to stay & work and me to find a better suited job?
