BVA for 820 Help

Exclamation BVA for 820 Help

My Work and Holiday visa (subclass 462) ends today at midnight, and I submitted my application along with payment for my 801/820 De Facto Partner visa yesterday. I waited so long because I wanted to make sure we were together for the full 12 months before applying. I thought the BVA kicked in automatically, but after reading some posts I realize it takes longer than that. I feel sick, and I don't know what I need to do. I love my partner, but don't want to stay illegally and breach my visa. Even if it kicks in later, will staying now be legal as I have submitted it before my current visa finishes? Any help is greatly appreciated!

Did you apply online or on paper? If you applied online, you typically would get an acknowledgement letter with the BVA almost immediately (maybe 10 minutes?) after applying. If you've applied by paper, I would expect it would take longer. I'm not sure if the BVA is then back-dated to your application date. Can you log into VEVO to see your visa status?

I applied online. I have received three emails shortly afterward. The first came with an "Acknowledgement of application" file attached from an automatic generator. The second one states my reference number again and says, "The status of this transaction has been updated." The third (again, after restating my TRN), "Correspondence relating to this transaction has been sent." When I log in and click on "view correspondence," it says, "No correspondence found."

It won't let me use my new TRN. It displays an error message. The visa grant number of my current 462 visa works when I input it, displaying my current visa stipulations (including today being my last day).

Your emailed a BVA after you submit your application online. For my partner and I we received this straight away, for others it has taken a day or more which is why it's generally best to apply with sufficient time left on your visa.
However if you have submitted a valid partner application and you don't receive your bridging visa you should be able to contact immi and they will send one to you backdated to when you made your application - I've seen this a few times now since the online system has been up and running

I think you're okay if you submitted online. Some people get the BVA immediately, others get it the next day. Don't worry too much. There's nothing you can do about it since Immi's closed now, and you'll probably get it Monday if you haven't by then. The worst that could possibly happen if you're unlawful for a day or two is that your time spent in the country before that wouldn't count towards citizenship, which, while that would suck, it's not like they're not going to come deport you or anything.

I was waiting because one of the requirements is to be living with your partner for 12 months, and yesterday made it 12 months exactly. I will be able to contact them on Monday during office hours at the earliest. Are you sure it will be backdated? This would be amazing! Thank you for your reply as well.

Yeah I understand, it's tricky
You definitly should have got a BVA - so give them a call on Monday if your havnt received it and they will send one through to you. I know it's hard but I wouldn't worry, your application was submitted prior to your visa expiring so providing you submitted a valid application your entitled to a BVA

Our BVA was not automatic it came from a human at the beginning of the next working day so you might get it Monday morning. If nothing by 930/10 I would give them a call.

Also don't forget to check your spam.

I'm going to continue worrying until it gets granted, unfortunately. I am hoping for the best though. I'm very glad there exists an online community such as this.
