Question 457 visa to PR - two years completed in 457 but not the same Nomination!Can I get PR?

Hi,
This February, i will complete my two years in 457 visa. But it is not the same nomination. First 8 months as a "Web Designer", and rest as a "Graphic Designer" with another Employer. (Due to Financial Crisis, i lost my previous job). So is there any chance for me to apply Permanent Residence through ENS? Please advise me. Thank you.

If your second employer and the nominated position was all approved then it should not be a problem.
There are different eligibility requirements for both employers and employees for the PR and so if they are met and the employer is agreeable, that is the first step.

Thank for your quick reply.

For ENS Employee Eligibility requirements (Subclass 856 Visa) It says,
You must also meet one of the following requirements:

* have worked full-time in Australia in the nominated occupation on a Subclass 418, 421, 422, 428, 444, 457 or 461 temporary residence visa for the last two years prior to the visa application being made (including at least the last 12 months with the nominating employer).

My case may be so rare. Already I have over 12months with my present employer. (1 year and 2months). The nominated occupation is the doubt that i have. I have no two years with the same Nomination by FEB.

If I apply for PR in FEB once two years complete, do I have to pay the complete fee?
Do i have to pay if only the Application is approved and PR is to be granted?
Is there any risk for my application to be rejected?

Really appreciate your answer and waiting for your advise.

I was basing my initial answer on the occupations being similar enough that you had been able to find a new sponsor on basically the same visa but if you have in fact made an application for a separate visa, that is a little different.

If that is the case it'll be best to give Immi a ring on that one or better still pop into an office and see if you can get a reasonably definite determination for you do have to pay the fee up front with any application and if it is rejected, your fee is gone.

If you have any doubt, just keep working the additional 10 months and then apply.
