Question what's the best temporary visa to get while waiting for partner visa to be approved?

My wife and I are currently waiting on paperwork to lodge our 309/100 visa application, once that is in (applying in South Africa), we would like to be together in Australia ASAP while waiting for that to be approved. Can anyone please tell us what would be the best temporary visa to apply for in the waiting period...... hopefully one that would allow my wife to gain employment in Australia before the partner visa is accepted?

She can only really look at getting a visitor visa, perhaps going for a six month one to hopefully allow enough time for the visa to be processed.

There is some risk attached in that your wife needs to be outside of Australia for the visa to be granted and though that can be done easily enough by a flight to NZ or elsewhere, it is not official policy that Immi have the responsibility to check where people are and advise them they need to leave Australia, thoughg that has happened in a number of instances I know of.
Regardless, the onus will be with the applicant and if for whatever reason, a change of staff for instance and the visa is presented for granting and the system rejects it because the computer indicates the person is in Australia, I am not too sure whether the system can take a backward step as bureaucratic as it may seem.

You may want to check with the Immi people in SA to see whether they actually have something in place locally to facilitate a check/advise/travel scenario and perhaps submitting a Form 1022 to have a greater chance of recognition could be appropriate.

If you do decide to go for a visitor visa, they do not allow for working though you can apply to have that restriction lifted and that will be decided on application.

Hi, I just applied for my partner visa (309/100) in NZ (as I had NFS on my current visa) and had to apply for another tourist visa to go back to OZ to wait for a decision on my application. Now they gave me 7 months tourist visa with no NFS. Does it mean by any chance that I don't have to go overseas when my visa is granted?? Or no, I still have to book a flight to somewhere else when they say my de facto visa will be granted?? sorry, sounds bit stupid but I got confused....

You will need to still depart Australia to get your partner visa granted.

thank you Wanderer...... the system seems to be full of different loop holes, and many ways to go about things which is very confusing and frustrating, and not knowing our best option! all we want to do is be together and start our lives, but every thing seems to lead to a risk! will take your advice on board and discuss this over the weekend, ty for all your posts and response's you have been very helpful to us both! thanks again and have a good weekend!!! The whole thing about needing to be offshore at the right time to get your visa, it does seem weird! Money & CO2 emissions wasted on all those pointless flights.
(I know immigration themselves might not set these rules... but I hope it will be fixed one day...)

Good luck JHFH. I hope you have success with getting the visa and your plans go ahead. I am currently in last stages in getting my de facto visa and been staying in South Africa waiting for it to be approved while my partner is in Aus. She has a job and things are going smoothly that side for her but getting my visa approved has been an up hill battle. If anything; I suggest not being apart until both of you have visas in order. They can take their time in getting things done.

I am keen to find out how people found the Embassy in SA and Migration agencies in SA to be. If their story is good or bad. I have read horror stories about Cairo and wondered how SA was. I'm finding it exhausting and an emotional trip

thank you CGR... i wish you the best also...... we are yet to submit the application as we are waiting on a birth certificate that was due in early december, we are submitting a complete application as we have heard stories of holding applications longer if they are not complete! its crazy we have been waiting for what seems an eternity for just this....... it is making things so frustrating for us.... will see how things pan out......

Thank you. I had to wait around 3months for the birth certificate. Police clearance took 4months but that was because they had so many strikes etc... Interested to see how you find the entire process. I'm finding the Embassy them self to be rude... Are you going through an agent or doing this yourself?

CGR..... well we had some success with police clearance, i think that was done within a month or 2, we have only last night just received notification of Birth certificate yesterday that its ready which has been many months..... my wife (KJR) will be dealing with the embassy in SA so i cant comment on how their service is just yet, but we are processing this application alone with no agent, only decision we have left is to decide if its done in SA or onshore...... which we will make by the weekend! will keep you posted ... and good luck again with yours!!! cheers J
