Aussie in the states wanna come home.

HI everyone,

Im new to the site and need some answers to a few queries i have for my cousin!

Any help would be greatly appreciated!!!

Ok my cousin moved to the states around 11 years ago,
met a wonderful man and got married and has 3 lovely kids.

They are wanting to come to the states...
What needs to be done?

Can her husband get through the residence process quickly since she IS Australian born?
Would he be able to obtain work legally as her husband?

Hi there,

So, just to be clear, your cousin wants to bring her spouse to Australia? Your subject line and the content of your post are confusing, so I just want to be sure.

If her husband is American, he will have to apply for an offshore spouse visa. The kids will be included as dependents. Processing times are up to 6 months or more, but it could be sooner depending on how many applications the DIAC office is handling at the time.

Please direct your cousin to the Australian embassy website wherever she is living to find out more details.

The children will already be Australian citizens though your cousin may need to apply for their citizenship grant if she has not done that previously and once having the ciyizenship they can get Aussie passports, possibly a couple of weeks for each step and that will simplify the husbands application.
Being married for a lengthy time and having three children will mean that the CO may be less fussed with as more evidence of the relationship being needed but they should still have a look at Booklet #1 via Family - Visas & Immigration re some of the stuff that ought to be provided.
Her husband will need to get an FBI check and that can take up to 10-12 weeks alone so he ought to get cracking on that.
But once with a partner visa and it'll likely be a PR one, he'll have full residence and work rights.
