prospective marriage visa

Hi all,
My case is kinda complicated and I really need advices. In short, I have a baby with an Aussie partner, but he can't apply partner visa sponsorship for me because he's married and his divorced is not finalised yet until this coming October. And it is so hard for us to live separately like this. I am wondering if there is any other options for us to stay together, can we apply prospective marriage visa while waiting for my partner's divorce decree? really appreciate for any advices.

The PMV is the visa that you cannot apply for at the moment because you need to be able to marry but a divorce not being finalised is not a restriction to a partner visa being applied for and you can proceeed with that.
As well as having had the baby, you will want to check all the eligibility requirements and have a read of Booklet #1.
