Please read!!!

Hello everyone, I recently moved to the Gold Coast for work and am being sponsored on a 457 visa. My visa hasn't come through yet but I have been forced to work illegally while waiting otherwise they said they wouldn't sponsor me. I have been paid cash in hand a total aof $486 for 30 days work, and they are saying I need to prove myself while I'm waiting and to use it as an experience. I have put my foot down now and said I will work when my visa comes through.

But I have several emails of them acklodgeing that I am being paid cash in hand whilst waiting for my visa, as well as some very abusive and threatening emails about if I dont do this or dont do that they will cancel my visa. I know they are liable for $165,000 in fines as a company, plus $15,000 as an individual but I'd like to know what other options I can use if things dont work out. Any advice would be very helpful

As surprising as it is to me that someone being considered for a managerial position would allow themselves to be put into a position of working illegally for a pittance, perhaps you need to be considering the ethics of the company.

Do you know for a fact that they have submitted the employer application and position nomination for approval?

But that is irrelevant to the illegality of your own situation and you could even find that they may attempt to exert more pressure on you even with a sponsorship visa granted and with that background it is best that you proceed on the basis of not having the sponsorship, advise Immi if you like and prepare to leave Australia.

Yes I am more than sure everything was lodged. My visa status is under further processing at this time. But if that's the case is it possible to take legal action? I gave up a lot to make this move, my car, home, left my family ect and if I did that for nothing I will be very disappointed. I'm more than prepared to let immi know either way.

There are people in the legal profession that do service people on immigration issues, actually registered as immigration agents whilst also having legal qualifications.
Contact with one would be a good idea for advice on your situation in respect to Immi and also taking action against the company.
You could probably find direction to suitable services via Migration Institute of Australia
