Hey,
We have lodged de facto onshore visa. We have been together for 7 years and provided substantial evidence of our relationship (emails, photos, letters, bank statements illustrating both payments between our accounts as well as our shared residence, bills, flights and accommodation for three holidays and statements from reliable witnesses).
My partner has been reported to immigration for non-payment of student fees. He has been interviewed by the department and stated financial hardship (limited funds detailing paying for the de facto visa due to priority, over student fees). Whilst applying for a de facto visa, he has been granted BVA.
If his student visa gets cancelled, will he be put on a BVE? Will this BVE override the BVA?
Furthermore, how hard is it to appeal for more lenient working rights if he does happen to be given a BVE?
Regards
