I have been paying taxes for the past 3 years and mid this financial year my contract had ceased. i am not on any centrelink payments and for the past 3 months i have been doing cash in hand work (cleaning part-time regularly every week)

in regards to the tax assesment notice for 10/11, i have spoken to my employer so he can put me in the books and start paying taxes because i would like to declare this as employment on the spouse visa sponsor form and on my tax assesment notice

my boss said that he will pay the taxes all in one hit, but wont be able to untill just before the end of the financial year. my question is when my boss declares me as working and pays the taxes for the periods that i had worked during the financial year the total will appear on my tax notice of assesment, which is no problem

but does immi step in further and request more info from ato, im not sure what info ato hold eg. date started working/paying taxes etc?? im just worried if they do request info direct from ato and they see that the date i started working on my form does not match the date tax payments started on ato records they may think its misleading information or even fraud

does any1 know what kind of information ato hold in regards to employment dates, and if immi actually go 1 step ahead and request more info from ato????

What may be legal for your boss is up to his company structure but most companies do have a requirement to withold taxation for employees and perhaps pay their own tax on a quarterly basis.
Cash in hand work usually infers an employee nor employer not paying tax and it's a dodgy area to get into and to keep your nose clean, you should have an employee declaration lodged with your employer and you ought to have something in writing as to your conditions of employment, something that cash in hand employers may be loathe to do.
It'd seem you need to get something established ASAP or you could have problems with taxation yourself and also your ability to show support as a sponsor.

As to records the ATO hold, they can be very extensive and if you claim employment for a period to support being a sponsor and Immi do check with the ATO and their record of your employment period is different, that's where your problems with both ATO and Immi could start.

If your employer has not provided you with a personal details declaration for taxation and is not providing any documentation for your employment, your alarm bells ought to be ringing and you could always make an anonymous enquiry with the ATO or if you know amyone in an accountancy area, see what they have to say.
